STANDARD TERMS AND CONDITIONS
The purchaser acknowledges that the contract, being the invoice and these standard terms and conditions, constitutes the entire agreement between Euro and the purchaser and Euro will not be bound by any verbal arrangements, representations or warranties which are not included in these documents.
Ownership of the goods remains vested in Euro until the purchase price has been paid in full.
We offer a unique service structure; including site meetings, storage facility, delivery, commissioning and demonstrations as stipulated on your invoice. Terms and conditions to qualify for these unique services apply.
Goods are stored for a maximum period of three months and are fully insured for that period. Terms and conditions to qualify for these unique services apply.
The date of delivery of the appliances to the Euro Appliances’ Store is seen as the date when the customer receives the goods, in terms of the Consumer Protection Act of 2011 which states “Customer’s right to return the goods within 10 business days after date of delivery”. The customer can visit the respective store to inspect the goods in this period.
No goods will be delivered unless the full amount has been paid or other arrangements have been made in writing. Deliveries will take place on working days from 8h00 till 16h00.
The risk of loss and/or damage to the goods shall pass on to the purchaser or their representative upon delivery thereof.
Additional cost of deliveries can be levied due to: incorrect or incomplete delivery address; for problems with access to the premises; delivery address exceeding 50km radius of Euro showroom.
Additional cost of commissioning can be levied due to premises not being ready for commissioning which results in additional deliveries and/or commissioning visits.
Euro only delivers and commissions the appliances; any additional carpentry, plumbing, electrical or any other work and/or cost to complete the commissioning will be the responsibility of the purchaser.
Early ordering will secure prices and availability of the appliances. Goods ordered and stored are immediately payable.
Handling fee of 10% – 20% (levied by suppliers) will be payable on standard items correctly ordered but returned for credit. Items unpacked and/or used cannot be returned for credit. Items made to customer’s specification or from suppliers overseas cannot be returned.
Euro refers the technical after sales support to the respective supplier.
Each supplier has his own Warranty and Guarantee conditions and Euro, as an agent for them, cannot act outside these Warranty and Guarantee conditions. The decision to replace appliances is taken by the respective supplier and not by Euro.
The purchaser shall not be entitled to make any deductions or set-off from the purchase price, in respect of any claim it may have against Euro.
Interest of 1% per month will be levied on all accounts exceeding credit terms.
Euro will endeavor to deliver on dates and times as requested by the purchaser. Delivery dates and times cannot however be guaranteed as we rely on availability and delivery times from the suppliers. Euro cannot be held responsible for delays beyond their control.
Euro shall be entitled to institute proceedings arising out of the contract in the magistrate’s court having jurisdiction over the purchaser, notwithstanding that the cause of the action may exceed the jurisdiction of such court.
